Material generated by usersThe State of Victoria may publish on prevention.health.vic.gov.au any material uploaded, posted, emailed or otherwise submitted by you and other users (‘User Generated Material’). This includes text, illustrations, photos, graphics, audio, video or other material generated by you or other users.

All User Generated Material published on prevention.health.vic.gov.au is at the sole discretion of the Department of Health and Human Services. It may remain on prevention.health.vic.gov.au for an indefinite period or may be removed at any time, at the sole discretion of the Department of Health and Human Services.

User Generated Material reflects the individual opinions or views of the relevant user. The State of Victoria, Department of Health and Human Services and Prevention.health.vic.gov.au do not endorse any advice or opinions contained in any User Generated Material.

prevention.health.vic.gov.au may monitor, moderate or exercise editorial control over User Generated Material and reserves the right but not the obligation to assess or examine the material when it is submitted.

The State of Victoria will not publish User Generated Material or will remove User Generated Material from prevention.health.vic.gov.au if, in the opinion of the Department of Health and Human Services, that User Generated Material is:

  1. incompatible with any Department of Health and Human Services or Victorian Government policy;
  2. misleading or false, or impersonating another living person;
  3. potentially libellous or defamatory;
  4. abusive, threatening, harassing, hateful, insulting, offensive, obscene, blasphemous or racially vilifying. For example, if your nickname is inappropriate or obscene your material may not be published;
  5. of nuisance value, inappropriate, off topic or vexatious;
  6. spam, promotes a product or commercial service, or solicits business;
  7. compromises your privacy or that of someone else, or breaches confidentiality;
  8. deliberately provocative of other community members.

When submitting User Generated Material you must provide a genuine email address. This is in case it is necessary to clarify any information or follow up an issue with you. Only first names or your preferred pseudonym (nickname) will be published on prevention.health.vic.gov.au. If you provide information to prevention.health.vic.gov.au by which your identity can reasonably be ascertained, it will only be used in accordance with the Information Privacy Act 2001 (Vic) and the Department of Health & Human Services privacy statement.

By submitting User Generated Material to prevention.health.vic.gov.au, you consent to the State of Victoria (including prevention.health.vic.gov.au and the Department of Health and Human Services) doing or omitting to do anything that, but for this consent, would constitute an infringement of your moral rights in the material (as defined by the Copyright Act 1968). This includes reproducing, publishing, performing, transmitting, exhibiting, adapting, altering or in any way changing or using the material:

  1. with or without attribution of authorship;
  2. with or without any other materials comprising copyright;
  3. with or without any other text, data, sounds or images;
  4. with no title, the same title or any other title;
  5. in any medium or context,
  6. in any way that the State of Victoria (including prevention.health.vic.gov.au and the Department of Health and Human Services) sees fit.

In submitting your User Generated Material to prevention.health.vic.gov.au, you grant to the State of Victoria a worldwide, royalty-free, perpetual licence to use, reproduce, edit, modify and exploit the User Generated Material that you submit, in any form or on any medium and for any purpose, including but not limited to:

  1. posting the User Generated Material on prevention.health.vic.gov.au website or publishing or disseminating it in a Prevention.health.vic.gov.au publication, or using other technology now known or developed in the future;
  2. using the User Generated Material in any promotions and marketing for prevention.health.vic.gov.au; and
  3. sub-licensing the User Generated Material to third parties.

By submitting your material to prevention.health.vic.gov.au you acknowledge and you warrant to the State of Victoria that:

  1. Your material is original, you own the copyright in your material and have the authority to grant a licence to the State of Victoria as outlined above.
  2. Your material is not confidential and does not contain anything that is obscene, pornographic, defamatory or in breach of any law or regulation.
  3. You have obtained the consent of anyone who is identifiable in your contribution for their personal details to be included in your contribution, or the consent of their parent or guardian if they are under 16.
  4. You acknowledge and agree that the State of Victoria publishes your material on prevention.health.vic.gov.au at its own discretion and is not obliged to publish or use all or any of the material you submit to prevention.health.vic.gov.au.

By submitting material to prevention.health.vic.gov.au you agree to indemnify the State of Victoria against all liability arising from any claims against the State of Victoria by third parties for loss or damage that arises from that material being displayed on prevention.health.vic.gov.au. This means that if a third party makes a claim against the State of Victoria that relates to the material that you have submitted, you agree to reimburse the State of Victoria for any loss or damage that it suffers as a result of that claim. Examples of when this might occur include: if the material is inaccurate or defamatory; or if the dissemination of the material is a breach of confidentiality or privacy, or an infringement of the intellectual property rights of a third party.

If you do not agree with the terms set out above, please do not submit or share your contribution with prevention.health.vic.gov.au. By submitting your material to prevention.health.vic.gov.au you will be deemed to have accepted the terms and conditions above.
